This platform, Aafia EMR (hereafter referred to as "Aafia EMR", "Platform", or "Service") is owned and operated by Aafia Technologies W.L.L., registered in the Kingdom of Bahrain (hereafter referred to as "Aafia", "we", or "Company").

Please carefully read and understand these Terms and Conditions before using any services provided through Aafia EMR. By accessing, subscribing to, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

If you do not agree with these terms, you must discontinue use of the Platform immediately and contact us to close your account.

1. Service description

Aafia EMR is a cloud-based electronic medical records and clinic management platform designed for healthcare providers in Bahrain, Saudi Arabia, and other GCC countries. The Platform provides tools for patient records management, appointment scheduling, e-prescriptions, billing, laboratory management, and related clinical workflows.

The Platform is provided as a Software-as-a-Service (SaaS) and requires an active subscription to access. Features may vary based on your selected subscription plan.

2. Limitation of liability

Under no circumstances shall Aafia Technologies W.L.L. be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of clinical data, revenue, or business interruption, arising out of the use, or inability to use, the Platform, even if Aafia or an authorised representative has been advised of the possibility of such damages.

Aafia EMR is a clinical support tool and does not replace professional medical judgement. All clinical decisions remain the sole responsibility of the licensed healthcare practitioner.

3. Subscription & licensing

Aafia EMR is provided under a commercial SaaS subscription model. Each subscription grants your clinic access to the Platform, including updates, support, and data storage, for the duration of the billing period (monthly or annual).

Subscriptions automatically renew unless cancelled at least 7 days before the renewal date. You are not permitted to resell, sublicense, or share your account credentials with third parties. Each clinic location requires its own subscription.

4. Data ownership & patient records

All patient data entered into Aafia EMR remains the property of your clinic. Aafia acts as a data processor on your behalf and will not access, sell, or use patient records for any purpose other than providing the Service.

You are responsible for ensuring that your use of Aafia EMR complies with all applicable healthcare regulations, including NHRA (Bahrain), SCFHS (Saudi Arabia), and any relevant data protection laws such as Bahrain's PDPL.

You may export your data at any time in standard formats. Upon account closure, your data will be retained for 90 days to allow retrieval, after which it will be permanently deleted unless otherwise required by law.

5. Refund policy

We offer a 14-day money-back guarantee on all new subscriptions. If you are not satisfied with Aafia EMR, contact our support team within 14 days of your initial purchase for a full refund. Renewals are non-refundable once the new billing period has begun.

6. Service availability & warranty

Aafia EMR targets 99.9% uptime but does not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance. The Platform is provided "as is" without warranty of any kind, expressed or implied.

7. Account suspension & termination

Aafia reserves the right to suspend or terminate any user account without prior notice for reasons including but not limited to:

  • Violation of these Terms and Conditions or applicable laws
  • Abusive or threatening behaviour towards Aafia staff or other users
  • Unauthorised sharing of account credentials or access tokens
  • Use of the Platform for purposes other than legitimate clinical operations
  • Non-payment of subscription fees after the grace period
  • Activities that compromise the security or integrity of the Platform

8. Privacy & data protection

We value your privacy and the confidentiality of patient data. Aafia EMR does not sell, rent, or share your personal or clinical information with third parties except as required to provide the Service. Your data is used solely for:

  • Providing and improving the Aafia EMR platform
  • Processing subscription payments and billing
  • Technical support and account management
  • Compliance with legal and regulatory obligations
  • Security monitoring and fraud prevention

By using Aafia EMR, you consent to the collection and use of your data in accordance with our Privacy Policy.

9. Governing law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain. Any disputes arising from the use of Aafia EMR shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Bahrain.

10. Changes to these terms

Aafia reserves the right to update these Terms and Conditions at any time. Material changes will be communicated to active subscribers via email or in-app notification at least 30 days before they take effect. Continued use of the Platform after changes constitutes acceptance of the updated terms.
